iOptions Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and iOptions, operated through ScanToToast (“iOptions,” “we,” “us,” or “our”). They govern your use of the iOptions mobile application, website, data, analysis, and related services (collectively, the “Service”). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy.

Important financial disclaimer: iOptions provides general informational and educational market analysis. It is not a broker-dealer, investment adviser, fiduciary, exchange, or financial institution. Nothing in the Service is individualized investment advice or a recommendation that is suitable for you.

1. Eligibility and accounts

You must be at least 18 years old, legally capable of entering a contract, and permitted to use the Service under applicable law. You agree to provide a valid email address, keep your credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account.

You may maintain only accounts you are authorized to use. You may not share credentials commercially, resell access, evade subscription eligibility rules, or create accounts to abuse trials, security controls, or Service limits.

2. The Service

iOptions displays monitored stock-option contracts, price changes, watch lists, market news, earnings forecasts, and AI-generated analysis. Information may be delayed, incomplete, unavailable, or inaccurate. “Top,” “positive,” “call,” “put,” “pick,” “recommendation,” “beat,” and “miss” are analytical labels generated from the Service’s rules and data; they do not promise a trade result or direct you to execute a transaction.

The Service does not execute trades, connect to a brokerage account, take custody of money or securities, or monitor your investment portfolio. You must use a separately authorized brokerage service if you choose to trade.

3. Subscriptions, trial, billing, and cancellation

Access to paid features requires the auto-renewable iOptions Monthly subscription offered through Apple’s App Store. The price displayed by Apple at confirmation is the price that applies to your storefront, including any applicable taxes.

Eligible new subscribers may receive a three-day free trial. Apple determines introductory-offer eligibility. Unless canceled at least 24 hours before the trial or current subscription period ends, the subscription automatically converts to the displayed monthly price and renews monthly until canceled. Apple charges your Apple Account at confirmation and for each renewal.

You can manage or cancel the subscription in your Apple Account subscription settings. Deleting the iOptions app or account does not cancel the Apple subscription. Refund requests and billing disputes are handled under Apple’s policies. Restore Purchases is available for qualifying purchases associated with the Apple Account currently used for App Store purchases.

Prices and offers may change prospectively as permitted by Apple and applicable law. We will not shorten a period for which Apple has already confirmed payment. Any access provided outside StoreKit must comply with Apple’s rules.

4. Investment and risk disclosures

All investing involves risk, and options can expire worthless and may result in the loss of the entire amount invested. Options strategies can involve additional risks, including volatility, liquidity, assignment, exercise, spread, pricing, tax, timing, and total-loss risks. Past or intraday performance does not predict future results.

Before making a financial decision, independently verify all information and consider your objectives, financial circumstances, experience, risk tolerance, and applicable taxes and fees. Consult appropriately licensed financial, legal, and tax professionals when needed. You alone decide whether and how to trade and are solely responsible for your transactions and losses.

We do not guarantee that displayed data is real-time, that an option is available or liquid, that an earnings event will occur at a stated time, or that any forecast, call, put, ranking, price, gain, or news interpretation will be correct.

5. AI-generated content

Some analysis is generated using artificial-intelligence systems. AI output may misunderstand sources, omit relevant facts, rely on stale or conflicting information, or produce incorrect conclusions. AI-generated content must be treated as an unverified analytical aid—not as a fact, guarantee, personalized recommendation, or substitute for professional judgment.

6. Third-party data and services

The Service relies on Apple, hosting providers, market-data providers, news sources, OpenAI, and other third parties. Their services and content may be governed by separate terms and may change or become unavailable without notice. Market-data and news rights remain with their respective owners. We do not endorse or control third-party websites merely because the Service links to or cites them.

Subject to these Terms and an active entitlement where required, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service on Apple devices you own or control as permitted by Apple’s usage rules. iOptions software, design, branding, compilations, and original content are owned by us or our licensors. No rights are granted except as expressly stated.

9. Availability, changes, and termination

Market conditions, maintenance, provider outages, security events, and other circumstances may interrupt the Service. We may add, change, suspend, or discontinue features, but will administer paid access consistently with applicable law and Apple’s policies. We may suspend or terminate an account that violates these Terms, threatens the Service, or creates legal or security risk.

You may stop using the Service at any time, cancel the Apple subscription, and delete your account in the app. Sections that by their nature should survive termination—including ownership, risk disclosures, disclaimers, liability limits, and dispute provisions—will survive.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, and results. We do not warrant uninterrupted operation or that errors will be corrected. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, iOptions and its operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, opportunity, or investments; trading losses; or damages arising from reliance on market data, forecasts, AI output, outages, or third-party services.

To the maximum extent permitted by law, our aggregate liability arising from the Service will not exceed the greater of (a) the amount you paid for the Service during the twelve months before the event giving rise to the claim or (b) US $50. This limitation does not exclude liability that cannot legally be limited, including applicable consumer-protection rights.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless iOptions and its operators from third-party claims and reasonable costs arising from your unlawful use of the Service, violation of these Terms, infringement of another party’s rights, or trading activity. This provision does not apply where prohibited by applicable consumer law.

13. Applicable law and disputes

These Terms are governed by the laws applicable where the Service operator is established, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence continue to apply. Before filing a claim, you agree to contact us and allow 30 days for an informal resolution. Nothing in these Terms prevents either party from seeking relief in small-claims court where eligible or limits rights that cannot lawfully be waived.

14. Apple-required terms

These Terms are between you and iOptions, not Apple. Apple has no obligation to provide maintenance or support for the Service. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by its rules; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for claims relating to the app, including product-liability, regulatory, consumer-protection, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable mobile-app license terms against you.

Apple’s Standard Licensed Application End User License Agreement also applies where required: Apple Standard EULA.

15. Changes to these Terms

We may update these Terms to reflect changes to the Service or law. We will post revised Terms with a new effective date and provide additional notice when legally required. Continued use after updated Terms take effect constitutes acceptance where permitted by law.
